Terms and Conditions
§ 1 Scope
These General Terms and Conditions (Terms) apply to all orders placed by consumers and businesses via the online shop https://mad-eel.com with Paul Fromm, Reichenbachstraße 43, 80469 Munich (hereinafter "we" or "us").
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly outside their trade, business or profession (Section 13 of the German Civil Code (BGB)).
§ 2 Conclusion of contract
The presentation of products in the online shop does not constitute a legally binding offer but an invitation to place an order.
You can initially add our products to the shopping cart without obligation and correct your entries at any time before submitting the order using the correction tools provided in the ordering process (changing colour, size or quantity, removing items from the cart, editing the address). By clicking the button "Place order and pay" you place a binding order for the goods in your shopping cart.
The contract is concluded when we accept your order by sending an order confirmation by e-mail. If you pay with a payment method that is executed immediately (credit card, PayPal, Klarna, Apple Pay, Google Pay), the contract is concluded as soon as the payment process is completed. If you pay by SEPA direct debit, the contract is concluded with the order confirmation.
We store the contract text (order, Terms, instructions on withdrawal) and send it to you by e-mail together with the order confirmation. The contract language is English.
§ 3 Prices and shipping costs
All prices are final prices in euros. In accordance with Section 19 of the German VAT Act (UStG), no VAT is charged and therefore none is shown.
Shipping costs are charged in addition to the prices shown and are displayed to you before you submit your order. The shipping costs are listed on the "Shipping & Payment" page.
For deliveries to countries outside the European Union, additional import charges (customs duties, import VAT, handling fees) may apply. These are not included in our prices and are payable by you to the competent customs or tax authorities or to the carrier.
§ 4 Payment
Payment is processed by our payment service provider Stripe (Stripe Payments Europe, Ltd., 1 Grand Canal Street Lower, Dublin 2, Ireland). The payment methods shown in the ordering process are available, in particular credit card, PayPal, Klarna, Apple Pay, Google Pay and SEPA direct debit.
The purchase price is due on completion of the ordering process. For SEPA direct debit, the amount is collected from your account after the mandate has been granted; the pre-notification period may be shortened to one day.
§ 5 Delivery and delivery time
The estimated delivery time (handling and shipping) is stated on the respective product page and under "Shipping & Payment". As soon as your parcel is on its way, you will receive an e-mail with tracking information.
We deliver to the countries listed under "Shipping & Payment". Shipping is carried out by a logistics partner commissioned by us to the delivery address you have provided.
If delivery is not possible because of incorrect or incomplete address details, you bear the resulting additional costs, provided you are responsible for the incorrect details.
§ 6 Retention of title
The goods remain our property until they have been paid for in full.
§ 7 Right of withdrawal
Consumers have a statutory right of withdrawal. Details can be found in our instructions on withdrawal, which also include the model withdrawal form. You may also declare the withdrawal via the withdrawal function on our website ("Withdraw from contract").
§ 8 Warranty
The statutory warranty rights apply. For consumers, the limitation period for claims for defects is two years from delivery of the goods.
Please check the goods for completeness and damage on receipt and report any transport damage as soon as possible – your statutory rights remain unaffected.
§ 9 Liability
We are liable without limitation for damage resulting from injury to life, body or health and for damage caused intentionally or by gross negligence. In the event of a slightly negligent breach of material contractual obligations (obligations whose fulfilment is essential for the proper performance of the contract and on whose observance you may regularly rely), our liability is limited to the foreseeable damage typical for this type of contract. Otherwise, liability for slight negligence is excluded. Liability under the German Product Liability Act (ProdHaftG) remains unaffected.
§ 10 Dispute resolution
We are neither willing nor obliged to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this choice of law applies only insofar as it does not deprive you of the protection afforded by mandatory provisions of the law of the state in which you have your habitual residence.
Should individual provisions of these Terms be invalid, the validity of the remaining provisions remains unaffected.
